That would be my preference: this is clearly a bug in the spec. Making it a "may" lets the Toolkit conform and lets any other tool that, for whatever reason, doesn't do it the Toolkit way to also conform. Frankly, I can't imagine a tool used seriously not doing it the Toolkit way, but you never know.
