You are absolutely correct, the browsers
are not happy.
Issue regarding omission of xml
declaration was related to IE’s unhappiness.
Now utilize <meta http-equiv="content-type"
content="text/html; charset=iso-8859-1"/> in the xhtml document head (enterprise requirement); utf-8 seems
to be much less problematic.
