I think that rule might be coming from the template named book.titlepage.separator in html/titlepage.templates.xsl.  Try setting that to an empty template in your customization.

I am creating a htmlhelp file with no TOC.

We don’t need the TOC here, the TOP is on the left frame anyways.

But when I remove the TOC, on the title page there is still the top rule (border).

 

I think this should also be removed when TOC is removed.
