Subject: Provisions of the LegalXML Member Section that affect TCs


All, 

I reviewed the Rules of Procedure for the LegalXML Member Section (found at http://www.legalxml.org/). Here quickly is what I found: 

Per the overview, the LegalXML MS “brings legal and technical experts together to create standards for the electronic exchange of legal data…. LegalXML [TCs] produce standards for electronic court filing, court documents, legal citations, transcripts, criminal justice intelligence systems, and others.” So the MS is intended to support the work of TCs developing data standards for the legal area generally. 

The TCs now active are: LegalDocumentML, LegalRuleML, LegalXML Electronic Court Filing (ECF v4.01 OASIS Standard 2013) 

The TCs now closed are: eContracts (eContracts v1.0 Committee Specification 2007), eNotary, Integrated Justice, Lawful Intercept, Legislative, Online Dispute Resolution, Transcripts 

The provisions of the Rules of Procedure that affect the member TCs: 

- Each affiliated TC must elect a member of the TC to serve as its representative on the OASIS LegalXML Member Section Steering Committee, so long as the Technical Committee is active.

- The MS can request resources from OASIS to support and promote TC work including: support for events such as interoperability demonstrations, conferences, and receptions; sponsoring events to raise awareness and to attract participants; and participation in industry-specific conferences and events.  

- The affiliated TCs must choose in their TC Charters to operate under the Royalty Free on Limited Terms IPR mode allowed by the OASIS TC Process policy. (This is the provision we must request be waived.) 

- The affiliated TCs may choose in their TC Charter to operate using any language of choice.

- The affiliated TCs must submit quarterly reports to the Chair of the Steering Committee indicating the activities of the TC, detailing how allotted funds have been used, and projecting any anticipated future needs of the TC.

In some exception cases, MS's have requested and OASIS has provided support for consultants to assist in drafting specifications, web site maintenance, etc. However, generally this work is expected to be done by the members of the TC and the TC must provide a compelling need for OASIS to consider the request.
