Subject: [OASIS members] OASIS announcement of LegalXML discussion lists
Upon the request by eligible participants I have created two additional OASIS Discussion Lists whose purpose is to discuss the creation of OASIS Technical Committees in the LegalXML member section. Discussion on the lists will begin in seven days to give everyone a chance to subscribe, and each list and its archive will be deleted after 90 days. The lists are legalxml-enotary-discuss@lists.oasis-open.org legalxml-legislative-discuss@lists.oasis-open.org Descriptions of the two lists are below. In order to participate in the discussions on these topics you should subscribe to the discussion lists using the subscription form at http://lists.oasis-open.org/ob/adm.pl or by sending a message to legalxml-enotary-discuss-request@lists.oasis-open.org legalxml-legislative-discuss-request@lists.oasis-open.org with the word "subscribe" as the body of the message. OASIS membership is not required in order to subscribe to this list. If you do not wish to subscribe but wish to view the discussion you may view the list archives at http://lists.oasis-open.org/archives/ ======================= Electronic Notarization ------------------------ (i) The requested name for the discussion list is "eNotarization TC formation" (ii) The scope of this discussion list is to explore the formation of an Electronic Notarization Technical Committee under the LegalXML Member Section of OASIS-OPEN, which would develop encryption-based technology standards for the creation and sharing of self-authenticating legal documents on the Internet, both within and between legal entities and/or individuals. While electronic signatures concern primarily legally binding transactions in electronic commerce, the notarization technical committee will focus on self-proving legal information of various types in environments which rely wholly or partially upon automated machine processes. The purpose of this committee is to develop an agreed set of technical requirements to govern self-proving legal information, crafted with particular attention to the historic policies and underlying legal doctrines governing admissible and inadmissible evidence in legal proceedings; the needs of legal documents suitable for real estate acquisitions and sales; wills and estates; affidavits and interstate judgments and court orders; and related administrative documents such as automobile documents of title; and to determine the suitability of such existing or emerging standards as the W3C/IETF dsig to the requirements identified by the committee; to abstract the common needs for self-authenticating legal information on the Internet from both Anglo-American and civil law jurisprudence; to put into context the historic requirement of signature affixation in the physical presence of the notary traditional in the paper world; and to produce a final technical specification tailored to legal requirements which works in conjunction with other existing and emerging technical standards, particularly those being developed within the LegalXML initiative." This TC would build from the work done previously in LegalXML, Inc, including at a joint U.S. Congressional and LegalXML public meeting on this topic.
