Think about someone having to listen to that from a text-to-speech system
when they are not out to read XML Markup but to read the specification and
find something that they are not intimately familiar with.  (I suppose one
would have to search the document(s) rather than browse, but why impose such
a penalty.)  

By the way, I feel that penalty without requiring assistive technology.  My
concern is that this is a human usability concern, and it is exacerbated
when accessibility comes into the picture.

[I am not religious about this, some others may be and should probably be
consulted.  It is a suggestion and I thank you for your thoughtful
exploration.]

[PS: I am on the office-comment list now.  Please don't send a duplicate
directly to me as well.  Now if I can just train my junk mail filter to file
these for me, when there appears to be no single "From" or "Sender" I will
be confident not to miss any.  The funny part is that arriving mail that
appears to be sent by me automatically goes to junk mail because (1) I
rarely do that and (2) spammers have misappropriated my return address as a
fake sender.]

Sorry, I am missing your point on that one.

How would that be different from an accessibility situation where 
someone is reading xml markup in an example? Or simply inline in a 
paragraph?

You may have a valid point and I am simply not understanding it yet.
