Unless anyone believes that Part 3, as written, _requires_ the use of any of the advanced features of ZIP that Alex mentions, I don't think we need to do anything here.

We go down a long, painful and unproductive road if we try to make every use of a patented technology be non-conforming.  It is enough that we don't require the use of patented technology.  Otherwise, we would need to forbid attaching audio files to presentations with certain codecs, forbid certain programming languages to be used in macros, forbid certain image formats, forbid the use of certain font technologies, forbid the use of certain DRM technology, etc.  

That said, we can reduce the cost to implement ODF if we make it clear what subset of the ZIP Application Note is required for conformance, e.g., making it clear which subset we want to mandate that implementors implement.  We do that already when we say to use DEFLATE or STORE algorithms.  If there are any other easy statements to make, then go for it.
