Information contained in envelopes is stripped in EAI,
middleware, and XML/EDI translator tools. This means that any information
from the envelope that is also needed in the application such as sender and
receiver is not available. This is a significant
problem.
UBL documents should contain all required information for
application processing independent of any details that may also be contained in
an envelope. Party details should always be at the header level for
application processing and audit trail requirements. This is true even when
those documents are resent by additional parties. If this detail is only
included in the envelope the data for application processing and audit
trail are lost.
It is quite common in North America that e-documents are
resent or routed by additional parties. In all of these scenarios,
the full details of all involved parties is contained in the document header or
at a line level if the Party information differs.

i am not sure the parties at the document root have anything to do
with who sends or receives the documents. typically they are parties to
whom the information on the document is addressed or who have some role in the

Just because some party is the Buyer Customer Party does not mean they sent the Order. These transportation documents are not used in the same way as in a procurement binary process where two parties swap documents back and forth. The documents follow a chain (or network) of parties - different parties can send the same documents depending on the role. so it does not help us to put the various parties (listed below) at the document root level. because this still does not tell us who sent this document or who it was addressed to.
