Dear OASIS Web Services Reliable Messaging TC:
Please find attached the Web Service Reliability Ver1.0
(WS-Reliability) specification that Fujitsu, Hitachi, NEC,
Oracle, Sonic Software, and Sun Microsystems (co-authors)
will contribute to the Organization for the Advancement of
Structured Information Standards (OASIS). In addition to the
rights and representations provided for in the OASIS Policy
on Intellectual Property Rights, the above companies also
make the following commitments:
[Fujitsu]
Fujitsu IPR statement: Fujitsu Limited ("Fujitsu") will offer
a Royalty-Free License under its Essential Claims (if any)
for any part of donated Web Services Reliability Specification
that is included in a specification adopted by OASIS. One
precondition of any such license granted to a party ("licensee")
shall be the licensee's agreement to grant reciprocal
Royalty-Free Licenses under its Essential Claims to Fujitsu
and other implementers of such specification. Fujitsu expressly
reserves all other rights it may have. Such licenses of the
Essential Claims (if any) by Fujitsu is made on an AS IS basis,
and Fujitsu expressly disclaims any and all warranties
regarding the Essential Claims, including the validity thereof.
[Hitachi]
Hitachi's IPR statement: Hitachi, Ltd. ("Hitachi") will offer
a Royalty-Free License under its Essential Claims (if any)
for any part of donated Web Services Reliability Specification
that is included in a specification adopted by OASIS. One
precondition of any such license granted to a party ("licensee")
shall be the licensee's agreement to grant reciprocal
Royalty-Free Licenses under its Essential Claims to Hitachi
and other implementers of such specification. Hitachi
expressly reserves all other rights it may have. Such licenses
of the Essential Claims (if any) by Hitachi is made on an AS IS
basis, and Hitachi expressly disclaims any and all warranties
regarding the Essential Claims, including the validity thereof.
[NEC]
NEC IPR statement: NEC Corporation ("NEC") will offer a
Royalty-Free License under its Essential Claims (if any) for
any part of donated Web Services Reliability Specification that
is included in a specification adopted by OASIS. One precondition
of any such license granted to a party ("licensee") shall be the
licensee's agreement to grant reciprocal Royalty-Free Licenses
under its Essential Claims to NEC and other implementers of
such specification. NEC expressly reserves all other rights it
may have. Such licenses of the Essential Claims (if any) by
NEC are made on an AS IS basis, and NEC expressly disclaims
any and all warranties regarding the Essential Claims, including
the validity thereof.
[Oracle]
Oracle IPR statement: Oracle Corporation ("Oracle") will
offer a royalty-free license under each of its patent claims
(if any) that are necessarily infringed by all technically
feasible implementations of any part of the donated Web
Services Reliability Specification (WSRS) that is included
in a specification adopted by OASIS. One precondition of
any such license granted to a party ("licensee") shall be the
licensee's agreement to grant reciprocal royalty-free licenses
to Oracle and other implementers of the relevant OASIS
specification under the licensee's claims that are necessary
to implement the above included parts of WSRS. Oracle
expressly reserves all other rights it may have. Such licenses
of the necessary claims (if any) is made on an AS IS basis,
and Oracle expressly disclaims any and all warranties
regarding the necessary claims, including the validity thereof.
[Sonic Software]
Sonic IPR statement: Sonic Software Corporation ("Sonic")
will offer a royalty-free license under each of its patent
claims (if any) that are necessarily infringed by all technically
feasible implementations of any part of the donated Web
Services Reliability specification (WS-R) that is included in
a specification adopted by OASIS. One precondition of any
such license granted to a party ("licensee") shall be the
licensee's agreement to grant reciprocal royalty-free licenses
to Sonic and other implementers of the relevant OASIS
specification under the licensee's claims that are necessary
to implement the above included parts of WS-R. Sonic
expressly reserves all other rights it may have. Such licenses
of the necessary claims (if any) is made on an AS IS basis,
and Sonic expressly disclaims any and all warranties
regarding the necessary claims, including the validity thereof.
[Sun]
Sun IPR statement: Sun Microsystems Inc. ("Sun") will offer a
royalty-free license under each of its patent claims (if any) that
are necessarily infringed by all technically feasible
implementations of any part of the donated Web Services Reliability
specification (WS-R) that is included in a specification adopted by
OASIS. One precondition of any such license granted to a party
("licensee") shall be the licensee's agreement to grant reciprocal
royalty-free licenses to Sun and other implementers of the relevant
OASIS specification under the licensee's claims that are necessary
to implement the above included parts of WS-R. Sun expressly
reserves all other rights it may have. Such licenses of the
necessary claims (if any) is made on an AS IS basis, and Sun
expressly disclaims any and all warranties regarding the necessary
claims, including the validity thereof.

Any claim in any patent or pending patent application that is
necessarily infringed by any technically feasible implementations.
