Yes, it should. That fact that it isn’t mentioned in the specification shouldn’t stop repositories to respond with a constraint exception in this case.

We might mention it in CMIS 2.0.

Should addObjectToFolder not throw a constraint exception if the repository does not support multifiling and this operation would file the object to a second folder?

In the "symmetric" case, removeObjectFromFolder is defined to throw a constraint exception.
