As I said previously, there is probably problem in your JAXP code or 
JAXP implementation you are using. If I do:

TransformerFactory trf = TransformerFactory.newInstance();

Transformer transformer = trf.newTransformer(new 
StreamSource(".../docbook-xsl/xhtml/docbook.xsl"));

transformer.transform(new StreamSource("docbook-document.xml"),
                       new StreamResult("output.xhtml));

I get output in proper encoding, which is same as one specified by 
<xsl:output/>.

But this problem is not DocBook related, it's related to JAXP interface 
or underlying implementation of JAXP (Xalan, Saxon, ...). You can get 
more help on list devoted to those technologies.
