Well, I think you will need to take this issue to the FOP mailing list, as it doesn't seem to be anything the DocBook stylesheets can control.

keep-together.within-column="always" property.  A processor that handles
such keeps properly will bump the whole block to the next page, but FOP
sometimes fails to do that.

By default, the DocBook XSL stylesheets do not add that property to lists
or listitems.  Does your customization?

It is also possible to use a processing instruction in your document to
add a keep-together property:

<?dbfo keep-together="always"?>

Does your list have such?

the footer?
