You are not alone here. The latest ideas in BP team revolves around 
removing isLegallyBinding and propose that a Flag is added to 
StandardBusinessDocument Header that signifies TEST or PRODUCTION or 
similar.

Which is by the way is supported by EAN.UCC, see attachment.
