The new should might need some further clarification. When an Error signal is bundled with another message unit it is unclear if a SOAP Fault should be added. 
If it is it raises questions about the HTTP status code to return (2xx or 500?). According to SOAP specification it should return 500 due to the fault, but it also contains other non-error information which means 2xx would be more logical.
Also it is not possible to include a SOAP Fault when the Error signal is bundled with a User Message message unit that contains a SOAP body payload as this will lead to more than child element in the SOAP body which conflicts with the WS-I basic profile requirements.

I would prefer to require the SOAP fault only when the Error signal is not bundled with another message unit or to remove the SOAP Fault requirement at all.
