I agree. A secure audit trail and a trusted server are prime
considerations. As to the binding legal effect of such signatures, I
think that depends upon the applicable national or state electronic
signature laws. In the US, the evidentiary presumptions are generally a
matter of state, not federal law. In several variations of UETA (the
Uniform Electronic Transactions Act) the result will depend upon the
type of signature technology that is used. Tight binding of an identity
to a document through crypto will result in a presumptively valid
signature. Loose binding will not. Boiled to its essence, if the
signature is presumptively valid, in a dispute over the signature, the
signer has the burden of proof that it was not his or her signature.
Otherwise the relying party has that burden.
