Thanks for this comment. I have created MQTT-501 https://issues.oasis-open.org/browse/MQTT-501to record this issue. All issues raised during the public review will be recorded in the TC issue database and reported with resolution after the end of the review period.

The Maximum Packet Size is sent only once per connection in both direction, so making this a variable byte integer would save just a couple of bytes per connection.
