I think the possibility of exceeding the server's RxMax with "immediate transmission" is acceptable.  Under those circumstances, the server would presumably be within its rights to disconnect the client because of the error anyway.  That is little different from the existing "immediate transmission" function, which takes no account of any errors - the sending client does not know if the message was successfully sent.
