Ken,  I think the return code IS REQUIRED - cite:  WD 11 Line 759 S 2.2.2 Return Code "The CONNACK, PUBACK, PUBREC, PUBREL, PUBCOMP, DISCONNECT, and AUTH have a Return Code as part of the Variable Header. SUBACK and UNSUBACK have a list of Return Codes in the Payload."
