Calling this a protocol error is inconsistent with the statement that the receiver MAY check it.  We do not for instance even say that the publisher MUST NOT send something marked as text which is not valid UTF-8.  We simply say the receiver MAY validate it and reject it.

On practical considerations, this is quite possibly something specified by the client application and if we make it a protocol error then a server (and full function client library) would almost certainly feel obligated to check it before publication.
