Actually, there was a question about what the standard had to say about this situation:

"This situation leads me to wonder what the ODF might have to say about the proper XML prolog usage in ODF documents and their parts.  And if having a DTD is appropriate, will the TC provide a "default" one that can be used for people such as myself who are very happy to use DTDs (along with schemas) in interchange of XML documents."

Naively written, looking back, but allowing <!DOCTYPE> and resolving relative references to DTDs (is this covered by ODF 1.1 17.5, you think?) is a matter of some interest with regard to being able to profile an ODF XML Document.
