See also OFFICE-2592 and OFFICE-1797 on aspects related to this issue.  It is important that a solution here be one that works backward compatible with ODF 1.0/1.1 and that Errata for ODF 1.0 also fit.

The new statement

chapter: *the index is constructed for the chapter that contains the index. A chapter consists of all those paragraphs and headings which have 
the same immediately preceding heading with outline level 1.* 

Is quite different than what might be meant by "current chapter" as used in previous versions of ODF.  Furthermore, the term "current chapter" is used heavily elsewhere in the ODF specifications and it is arguable whether the above is a breaking change or not.

I think there are two ways to specify this, and we need to say which it is.  However, either way, there remain issues what preceding heading is involved depending on where the <text:table-of-content> element appears.

I think you have variations on these choices:

1. The chapter consists of everything following the nearest preceding <text:h> element having outline level 1 and preceding the nearest following <text:h> element having outline level 1; when there is no such preceding or following <text:h> element or the <text:table-of-content> element occurs within a <text:h> element having outline level 1, the behavior is implementation-dependent.  [There may need to be more exceptions than occurrence in <text:h>.]

2. The chapter consists of everything following the nearest preceding <text:h> element and preceding the nearest following <text:h> element having the the same or lower outline level value; ; when there is no such preceding or following <text:h> element or the <text:table-of-content> element occurs within a <text:h> element with the same or lower outline level as a preceding <text:h>, the behavior is implementation-dependent.  [There may need to be more exceptions than occurrence in <text:h>.]

I suspect that (2) may be the most consistent with how chapter and current chapter are used throughout the ODF 1.x specifications.  It may not reflect what has been done with implementations and whether that should be construed as a conforming implementation-dependency or we should warp the specification into making it the defined case.
