The <draw:path> element refers to svg:d directly. And there you find a 
rule in 
https://www.w3.org/TR/2003/REC-SVG11-20030114/painting.html#FillProperties

As SVG specifies an implicit close, the sentence "Graphic objects that 
are not closed will not be filled" and the Note are still needed. So do 
not delete them. They should have been included in the proposal. Thank 
you for noticing the problem.
