When a JMS binding instance is configured on the service or reference where the JMS intent is applied (or any other binding that provides the JMS intent). There's no policySet.

You are correct!
Let me phrase this as a question.  Suppose an implementation is using
External Attachment and there
is a SCDL with the JMS intent attached.  The SCDL is valid.  When/how is
the intent satisfied?
