I think you are being melodramatic.

Since the Danish government is using UBL - I think it highly unlikely
Microsoft will win any cases here.  Who are they going to throw in
Guantanamo as an XML terrorist - the Danish Minister for IT?

Ditto XML itself.  Every western government is probably in 
violation of this XML patent, along with major corporations.

At least you will have good company as cell mates!

I would not be losing too much sleep on this one - I'm sure
there are Australian government institutions you need to be
worrying about before the US Government, in targetting
a shopping mall somewhere near you!
