Please explain "resolved this issue".

By "this issue" do you mean just the addition of a basic informative note describing the IE difficulty?  I wouldn't think that simple note -- "cannot use 'data' attribute and param element together" -- would not be problematic with the implementors. 

Or by "this issue" do you mean (implementors) nailing down more precisely what does/doesn't work, such as your success using 'data' attribute while avoiding querying for param subelements?

If I'm missing your meaning, please clarify.

(Btw, all implementors already have or are willing to implement a non-standard, prototype SRC <param> as a workaround.  "Prototype" because it would likely be a feature of the next technical upgrade of the standard.)
