Exactly what is the meaning of "which by definition is open"?
 
Your understanding of this - compared to what the new IPR RF allows
may be an issue - it certainly is for the OSI license folks.

Hi.

I maybe completely off my tree here. But does not the IPR policy only
apply to the actual content from the TC?

So here only the EML specification is bound by the policy?
If this is the case then surely any work outside of the committee by
individuals or companies is not bound by this license, only the EML syntax
itself. Which by definition is open.
