This AG opinion was a HOT topic at the PRIA Winter Conference last week.  Several of our members are Texas county clerks and things were changing daily.  Fortunately the AG set-aside his opinion for 60 days to allow further consideration.

 

Unfortunately, this is a painful example of how little understanding there is regarding the public records system (both court and land records) in the US.

You may have already seen an article on this topic.  It sounds like this is especially disruptive for the Texas courts. And it probably won't be long before this issue gets much more attention in other states.
