However on your last point, 'the server MUST NOT retransmit the offending packet on a subsequent connection', I'm wrestling with two different mechanisms. A packet that exceeds the agreed maximum should never be sent. But if it is, it's a protocol error. However, I wanted to make sure that implementations didn't automatically retransmit the unacknowledged oversized packet. It seemed to me the implementer might overlook that (i.e. that the unacknowledged packet list. So I added the text the server MUST NOT retransmit the offending packet on a subsequent connection, in keeping with the restriction it was prohibited in the first place.
