Rex,

I read the definitions you provided a bit differently than you. 

In both cases, the is a *PARTY* and a result of the *PARTY*'s action, not Action per se.

For Non Repudiation, we need the document/transmission the fact of existence of which is repudiated (or not)

For Confidentiality, we need an info that is supposed to be protected from others. 

How transmission/into 'happened', i.e. the Action, does not matter IMO.
