I agree that merging should not be automatic using the topic naming constraint. I have not the impression that this had been the case until now. It is an incentive for applications, but not more. The subject-based merging rule is much stronger because of the absolute value of subject identity points. Unless I didn't get the point, I don't see any incompatibility between what you want and what we have. Probably we should clarify the text in order to remove any possible ambiguities.
