Subject: Scope of SAP patents related to UBL and ebXML
Dear Claus, I am writing this inquiry in my capacity as Chair of the OASIS UBL Technical Comittee. It has come to the Committee's attention that SAP and/or Dr. Gunther Stuhec may be the named patentees/assignees of patents purporting to claim technology relating to the work of OASIS and UN/CEFACT in constructing UBL and ebXML. Therefore, our Committee respectfully requests and would appreciate a statement from SAP and Dr. Stuhec as to your position concerning the extent to which any patents held by either may claim all or a portion of the work of our Committee. Furthermore, we also request your position as to the extent to which you anticipate attempting to assert claims, if at all, against implementers of the technology adopted as a standard of our committee. We request a response in 30 days, preferably sooner, and greatly appreciate your cooperation. Nothing in this inquiry is intended to suggest that we believe any patents are relevant to any of the work performed by our Committee. Nothing herein is intended to constitute an admission or acknowledgment of liability or infringement of any kind. Thank you.
