Subject: RE: Request to Run IPR Transition Ballot - XLIFF TC
All: I have received a request to reconsider the IPR mode that the XLIFF TC will transition to. The TC originally selected "RF on RAND" terms to transition to. The request is to select "RF on Limited Terms", which is a more open IPR mode. As I understand it, both RF IPR modes require granting licenses to all, and forbid fees or royalties. But RF on Limited Terms specifies the exact Royalty Free licensing terms and conditions that may be included in a patent holder's license and that must be granted upon request without further negotiations. RF on RAND mode allows the license terms and conditions to be negotiable. As the request is to select a more open IPR mode, I am fully supportive of it. However, it is up to the TC to decide if we should reconsider the recommended IPR transition mode. For organisational members, it is important that you confer with your primary representative as they may have organisational requirements or standards for IPR modes that you may not be aware of. For individual members, it is important that you confer with your organisation's senior management and/or legal department. If there is no further discussion and no objections, in one week's time I will submit a new ballot to select the IPR transition mode, with "RF on Limited Terms" the recommended mode. Apologies for the deluge of ballots of late, but the IPR mode is very important and is worthy of the effort to get it right.
