I think you really point out where we need to continue the discussion (even we should keep an eye on how much this is still related to the "hierarchical" part of our topic).
One use case I would like to mention here is the DoD 3 specification (from which I assume that it has some impact on a couple of our repositories). In the latest spec they define some test cases around how to deal with metadata embedded in content. One example is that  you might have to enforce a user providing certain values for such kind of metadata and that a client has to provide a user interface. So if we consider this stuff as being important for CMIS we should have a look at the DoD requirements as well.
