That's a bit misleading.   They had filed the patent on or about
the time they moved the work over into ebXML / OASIS.

That situation has been resolved between CEFACT/OASIS
and IBM.

The PTO process is farcical at best here - one of these
years someone will actually do something at the root
of the problem - till then we have to live with the 
outcomes : -(

Didn't IBM secure a patent for an OASIS spec last year. How was that
resolved?  Should not the standards adoption process avoid this mess!
