Subject: Regrets and Comments on OLSI meeting


Folks,

 

I have been called into a meeting that is in conflict with today steering committee meeting.  It's going to be making specific business critical decisions that I have to be part of.  I will not be able to attend today's meeting.  My sincere apologies.

 

Attached is presentation that I gave at the Open Legal Standards Initiative meeting in New York. Enclosed also are my recommendations to the chair of this effort Kelly Ray worked with me on trying to open up the legislative area.

 

My short observations on the meeting is that this is a very early stage attempt to coordinate legal standards that go well beyond those markup.  They may be supported by markup but are not markup driven. I look at many of the standards along lines of the efiling process standards that we used as input to our requirements for ECF 3.0. They are touching on the general business process and metrics based approaches to operate in the legal space.

I note in the introduction that I do not recall being informed of the Board’s action on our proposed change to our ROP requiring TCs to adopt the Royalty Free on Limited Terms OASIS IPR mode.  Have I simply forgotten the resolution of that matter, or has no action been taken?

 

This will be my last quarterly report.  It has been an honor to serve as chair of the LegalXML Member Section for the past two years and to work with you and the OASIS Board in that capacity.  I am confident that John Messing will perform admirably as my successor.

Good morning Kelly,

 

I want to send you my thoughts on yesterday's meeting and the implications for the next meeting.

 

First, we have two sets of standards involved in these discussions.  In some ways this is similar to the relationship between court filing processes and enabling rules to the electronic court filing standard.  One cannot do good technical standards without having a solid understanding and some knowledge of the processes that the technical standard would be supporting and further the constraints that the technical standard may encounter and may need to adapt to.

 

By your nature, you tend to be a quick action individual, wanting to move things along as quickly as possible.  However, when you are creating a group or more a team you must have the expectations that it will go through the standard forming, norming, conforming and performing stages of development.  The goal would be to get through the stages as quickly as practical.  The key here is that you have to create an environment where trust is possible.

 

A very good way of creating such an environment is to reflect on and represent the true nature of the environment.  Your concept of creating a diagram of the standards is a good one.  One way of reflecting this is to show a ven diagram of the standards and where they may have overlap.  If you then refactor the diagram into a second diagram that spreads out the policy and process standards from the enabling technology standards and showing arrows between them showing primary dependencies and feedback change control flows between related standards it may show the universe and the correct light.

 

As I mentioned in New York, a good way of doing this is to use a workshop format using central sessions to work through common concepts and goals.  Then, going into breakout sessions one set at the policy and process level and one set in the implementation/supporting level of standards.  You then bring them back together to share the results between the two and to reflect and respond to the observations brought forward by each of the breakout sessions.

 

The most important item may be to identify the initial mission and goals of the organization.  Is the mission and goal to be focused at the policy and process level, at least in the short term or is there merit to having the implementation/enabling standards involved at this time?  The group needs to decide this important question or one or more of the subgroups may become frustrated as I observed some frustration in the meeting yesterday.

 

Again, these are my initial thoughts.  I think there is value in getting the full set together again using the format I described above.  I believe this will help us set the initial correct balance.

 

FYI -- I am dictating this using the Dragon software and have not needed to do a huge number of manual corrections.  This remediates the fact that I am a lousy typist.

Don – are you aware of a woman that would be involved with leadership at LegalXML that is coming to attend?  I had a conversation with a woman who advised that she would be attending (it may have been Susan Smoter, but I don’t think so because she specifically referenced the LegalXML leadership team in our conversation).  I mistakenly wrote down that I was receiving a confirmation from Robin Gibson.  I’ve now cleared it up that I was not apparently talking with Robin Gibson, but am not sure I have this other woman on my email listing in order to make sure she has an update on logistics.
